Thanks for downloading the Tactix App (“the App”). This Privacy Policy explains how we collect, use, and disclose personal information (as defined in this Privacy Policy) relating to the user’s (“you” / “your”) use of the services provided by the App, The Sequoyah Fund, Inc. (the “Sequoyah Fund”), and/or Disciple Media Limited (“Disciple”) and any associated services (the “Service” or “Services”). By using the App and/or Services, you agree to the terms of this Privacy Policy and the associated Terms of Service (available at www.tactix.org/terms-of-service). Thank you.

This Privacy Policy has been created to help you understand the personal data which we may collect, how we intend to securely process and store that data, how we may share this data, and the rights you have in relation to your personal data.

Along with the Terms of Service (available at www.tactix.org/terms-of-service), this Privacy Policy makes up our agreements with you as a user of our App, and we need to ensure you understand these agreements.

FULL PRIVACY POLICY

1. Introduction

For purposes of this Privacy Policy, “Disciple Media” shall mean “Disciple Media Limited.”  

“Sequoyah Fund,” “we,” “us,” or “our” shall mean “The Sequoyah Fund, Inc.” having contact information of 810 Acquoni Rd., Cherokee, NC, US 28719, telephone (828) 359-5003, email: info@tactixapp.org.

“Data Controller” shall mean “Disciple Media” and the “Sequoyah Fund,” collectively.  

This Privacy Policy describes your relationship with us with respect to information that identifies you or can be used to identify you (referred to as “personal information” or “personal data”) when you use the Tactix App (“App” or “Tactix”), website(s), and/or other online products or Services that link to this Privacy Policy or when you otherwise interact with the Tactix App or Services. 

This Privacy Policy will help you to understand what information we collect and process using the official Tactix App Application and related Service (and related Website used to support account management and sharing of posts on social media and other platforms), and the choices and rights you have in connection with your personal information.

The Data Controller is responsible for determining the processing purposes of your personal data, and the content and related services or features which are made available to you from using this Service.

From time to time, we may develop new services or offer additional services. If these evolving services materially change how we collect or process your personal information we will communicate that to you. Unless otherwise stated, this Privacy Policy will continue to apply to these new or additional services.

This Privacy Policy is intended to:

  • ensure that you understand what personal information we collect, why we collect and use it, and who we may share it with;

  • explain how we use the personal information you share; and

  • explain your rights and choices relating to the personal information we collect and process about you and the steps we will take to protect your privacy.

2. What is the Purpose of this Service?

The purpose of this Service is real-world tools, training, and networking to grow your business on your terms.

3. Where do we collect personal data about you from?

We may collect personal data about you directly from you. This is information you have voluntarily provided whilst entering your personal details on the Service. We do not collect personal data about you from an agent/third party acting on your behalf.

4. What Information Do We Collect and Why?

We will only ever collect the information we need to enable us to undertake the specific information processing activities noted later in this section. We collect and process two distinct kinds of information:

  • Non-personal information such as the pages you have accessed, helping us to determine how many people use our Service, how many people visit on a regular basis, and how popular each of our pages are. This information doesn't tell us anything about who you are or where you live. It simply allows us to monitor and improve our service.

  • Personal information such as your IP address, email address, username, password, approximate location and any optional information you may choose to provide to us as part of your experience within the Service (e.g. text, photograph).

Should you decide to register we ask for the following information:

  • Email address – we use this to send you a welcome email, and any service related communications such as resetting your password or verifying your email address. We will not send you any marketing or third-party messages unless you have explicitly provided your consent for us to do so.

  • our name/username – we ask for a username so that if you make any posts or comments that these are attributable to you. Other users will also be able to search for you by name, and it will be shown on your public profile page. You do not need to use your real name, though we generally encourage it.

  • A photo – this is optional, but if you add one this will be shown next to any posts and comments you make, as well as on your public profile page.

  • A password – we store this in a secure one-way encrypted system. If you forget your password, you may request that it be reset, and we will send an email to you with instructions on how to do so.

Once registration is complete, we process the following information: Posts and comments in the App that you choose to make available. Please bear in mind that any posts and comments you make are in the public domain and may be viewed by non-registered users in the App, on public web pages, and by other users of the App via periodic emails showing recent App activity.

You may also send friend requests to other users and, should they accept, you will have the ability to send one-to-one and group messages to them. These messages are completely private between you and any other recipients and are not monitored.

As you use the App we will keep track of what sections you have visited, so that we can highlight sections or content to you that you may have missed. We also use this data in an aggregated form to understand how popular the App and its different sections are so that we can improve the service. 

We record the last IP address you accessed the service from so that we can protect the service from malicious access. As part of this we may look up the approximate location of the IP address such as country and city.

Your decision to disclose your personal information to us is entirely voluntary. If you do not provide the personal data necessary, or withdraw your consent for the processing of your personal data, you may not be able to access or use the App’s functionality.

We comply with all legislative and regulatory information retention requirements and will securely and permanently delete your personal information when there is (a) no reasonable justification for its further retention, or (b) you have asked us to delete it. 

We may share personal information about you as follows or as otherwise described in this Privacy Policy:

  • We may share your personal information with our affiliated legal entities where necessary to fulfill a contract or precontractual measures, or where we have a legitimate interest in doing so (such as providing you with access to the App and associated services, providing customer support, or App development, updates, and/or improvements) or a legal obligation to do so;

  • With vendors, consultants, and other service providers who may process your information on our behalf when they provide services;

  • With partners with whom you may have a relationship, in order to coordinate with them on providing the Service to members and providing information about the availability of the Service;

  • With other third parties who use it for their own purposes if you have provided consent;

  • With researchers, content providers, and other business partners for activities such as academic study or research related to entrepreneurship and online community and education, but only in a de-identified format;

  • With other users of the Tactix App and/or Services, including sharing comments, posted pictures, and/or other user-generated content;

  • In connection with, or during negotiations of, any merger, sale of company assets, financing or acquisition of all or a portion of our business by another company;

  • We and our service providers may disclose and otherwise use your personal and other information where we or they reasonably believe such disclosure is needed to (a) satisfy any applicable law, regulation, legal process, or governmental request, (b) enforce applicable terms and conditions of use, including investigation of potential violations of such terms, (c) detect, prevent, or otherwise address illegal or suspected illegal activities (including fraud), security or technical issues, or (d) protect against harm to the rights, property or safety of us and/or Disciple Media, our users or the public, as required or permitted by law.

We may also share aggregated or de-identified information, which cannot reasonably be used to identify you. For example, we may share aggregated or de-identified information with research partners and services providers so that we, and they, can understand how users use the service.

The App and/or Service may allow you to share information by email, text message, social media, or other sharing applications, using the clients and applications on your smartphone, mobile telephone, tablet, and/or computer.

In addition, the App and/or Service may contain content and social plugins and similar technologies operated by third-party social networks. These plugins may allow you to share information from the App and/or Service to your account.  When you connect to these third-party social networks, they may store and/or access data (including through the use of cookies and other similar technologies) over which we do not have control. We do not control these third-party social networks or their platforms, and your usage of these third-party social networks is subject to the applicable third-party social networks’ terms of use and privacy policy. 

5. Children’s Personal Data

This Service, and any services available from it, are not directed to users under the age of 13. If you learn that a user under the age of 13 has provided us with their personal information without having parental or guardian consent, please contact Us (see Section 12) immediately so we can take appropriate action.

6. Marketing and Third-Party Websites

When you sign up for a promotion or create an account/subscribe to the App and/or associated Services, we may use your personal information to send marketing messages to you. If you opt not to receive marketing messages, we may still send you non-marketing emails, such as transactional emails regarding your account and/or your subscription to the App/Services.

In some instances, the App and/or associated Services may be integrated with third-party services or include links to third-party websites, apps, and/or social media platforms (collectively, “Third-Party Websites”), including those in the following non-exhaustive list. These Third-Party Websites are responsible for their own privacy practices, so you should pay attention anytime you are redirected to a third-party website and be sure to review its privacy policy. By clicking on such Third-Party Website links, you may permit a third party to collect or share your personal information and/or personal data. We do not endorse or control Third-Party Websites. By reading the terms of service and privacy policy that may apply to such Third-Party Website, you may learn how that site will process information about you. We accept no responsibility or any liability for damages or other harm to anyone from your use of Third-Party Websites. Please appropriately protect yourself when accessing such Third-Party Websites, particularly when downloading or purchasing anything from such Third-Party Websites.

7. International Transfers of Personal Data

As we have described above, to be able to provide you with the Services we may transfer your personal data to partners in different countries. These countries’ privacy laws may be different from those in your home country.

Should we transfer data to a country which has not been deemed to provide adequate data protection standards We always have security measures and approved model clauses in place to protect your personal data.

If you are based in the EU, by voluntarily submitting your personal data to us you consent to these international transfers. If you later wish to withdraw your consent, please contact the Data Controller using the details in Section 12.

8. Use of Cookies

Cookies are small text files sent by websites to your web browser and sent back to them each time you access or use the site, and they may be necessary for the site to function. They are unique to you and/or your web browser and may contain personally identifiable information as well as technical information (e.g. your device manufacturer and model, screen resolution, internet service provider, browser, and geo-location data). Session-based cookies last only while your browser is open and are automatically deleted when you close the browser. Persistent cookies last until you or your browser delete them, or until they expire.

When using this Service, you should be aware that the App and/or web browser elements of the Service may use cookies. Third- party websites which we, or other users, may link to may include or utilize cookies. These third-party sites are outside of our control and we cannot guarantee their behavior. These third-party sites may use both session-based and persistent cookies, dependent upon the functionality in those sites.

When posts are shared from the App into social media, the webpages in the Service that support this feature do use cookies to anonymously gather metrics on which pages are the most popular.

9. External Links

The Services may include relevant hyperlinks (posted by us or App users) to external websites which are not directly controlled by us. Whilst all reasonable care has been exercised in selecting and providing such links, you are advised to exercise caution before clicking any external links. We cannot guarantee the ongoing suitability of external links, nor do we continually verify the safety or security of the contents which may be provided to you. You are advised, therefore, that your use of external links is at your own risk and We cannot be responsible for any damages or consequences caused by your use of them.

10. California Privacy Rights

Under the California Consumer Privacy Act (“CCPA”), California residents have the right to know what personal information is collected, request deletion of their personal data, opt-out of the sale or sharing of their personal data, and not be discriminated against if they choose to exercise any of these rights. If you would like to exercise any of the rights afforded to you under the CCPA, please contact us in accordance with Section 12 of this Privacy Policy. 

Under the California "Shine Your Light" law, California residents may also have the right to request certain details about personal information that we may share with third parties for those third parties’ direct marketing purposes. If you would like to exercise any of the rights afforded to you under the California “Shine Your Light” law, please contact us in accordance with Section 12 of this Privacy Policy. 

11. Changes to this Privacy Policy

We may change this Privacy Policy from time to time, and if we do so, you will be notified at your next available interaction with the Service, at which time you will be provided with the updated Privacy Policy to review and consent to before you are able to continue using the Service.
